What happens when seller and buyer do not agree on when the due diligence period took place and there is an ensuing EMD dispute?

I entered a contract to purchase a foreclosure, and the selling agent informed my agent, by email, that our due diligence (DD) would start once the work to the house being done by the selling bank was finished. However, the seller was under the impression that the work was all done several days earlier than actually completed, and believes DD therefore started at that earlier time. The truth of the matter is that when we were told the work was done, my agent and I visited the property and found that (1) the work was not complete, and (2) we were still locked out of the property. A few days later, we decide to back out, within the true DD period, and 3 weeks before COE. The seller insists that we lose EMD because selling agent is insisting her DD timeline is accurate. I see few options beyond small claims court and a formal complaint to the NV RED against the seller's agent. Any thoughts? Thank you in advance.
