How to get escrow deposit back if the seller refuse to sign the escrow cancelation addendum?

Calling all experts to help!! I have canceled the purchase contract for a forclosed property after reading the CC&R. I know under the Nevada State Law, NRS 116.41095, I have 5 days to cancel the offer from the date I received the resale package. I received the resale package on 6/27/11 and submitted the escrow cancelation addendum on 6/29. However, the seller (Bank of America) refuse to return the deposit because they claimed that in the contract, it states that the buyer is responsible to obtain CC&R within 10days of signing the offer and have up to 15 days to cancel the offer. The offer was signed on 6/6/11. In short, the purchase contract is conflicting with the current Nevada State Law. My agent is not forthcoming and I do not have a buyer's attorney. Please please please help!!
