| Banktrupcy-give up the house or keep it??? Help!!! Posted: 20 Sep 2009 08:38 PM PDT My husband and accumulated a lot of credit card debt after he lost his job and I got salary cut. Since the cr cards and the home are under my name only, we decided that I would declared bankruptcy by myself. However, we do not agree on what to do with the house. We owe 180K, but its only worth 105K. I say: include it in the bankruptcy, live in a small apt for while, save a sizeable downpayment and HE buys a home at a better price (I can't because of the bankruptcy). He says: we invested a lot of $ in the house, keep it, eventually it will go up in price. But, how long do we have to wait to have some equity in the home again? I like my house but is the bankruptcy a good opportunity to get rid of a house that is not worth the debt that we have with the bank? Even if all my credit card debt is discharged, we only make enough to cover our basic expenses each month. If things get worse and we cannot make the payments later, is it worse to loose it to foreclosure?    |
