Posted: 12 Oct 2010 04:56 PM PDT Due to an unsatisfactory inspection, I have decided to not purchase a home, and requested to be returned my earnest money deposit. My agent wants me to fill out an Authorization For Release Of Earnest Money Deposit in 5 days. It has the usual language, however, On the bottom of the form, is the following statement: "The undersigned hereby agree to hold each other, all real estate brokerage agencies involved in the transaction and their licenses harmless from any and all claims, suits, actions, and damages arising out of such agreement" I intend to seek legal action due to misrepresentation issues by both my Buyers Agent and The Sellers Agent and their respective brokerages. I was wondering if the said language in the Authorization For Release Of Earnest Money Deposit would prevent me from seeking relief from damages / legal action? Please Help! Thanks! |
