| Posted: 05 May 2010 08:51 PM PDT Here's my situation: My realtor is working with the listing agent (who's also a realtor in the same office--don't know if that was my first problem) on this short sale for $133,000 with 3% concessions on March 17. Listing price is $134,900. They counteroffered with the same terms but with only 1.5% concessions on April 20. I accepted thinking I have a chance for the $8000 tax credit. I did my home inspection within 10 days but without the actual purchase contract in hand. Yesterday I just received an email from my realtor saying that Bank of America has come back with their counteroffer with a $1000 increase in price to $134,000 and they won't pay HOA transfer fees, home warranty fees, and HOA and sewer delinquency fees. Ethically, I know it's wrong, but legally is there any recourse? Also, if I accept their increase but decline the HOA and sewer fees, can they pro-rate the date of the purchase contract to April 20th for my tax credit without getting into trouble with the IRS? |
