Are lenders pursing deficiency judgments? Posted: 21 Oct 2009 01:00 PM PDT We just lost our home to foreclosure (we were so close to a successful short sale, but the 2nd lender forced foreclosure before the short sale was done) and we are concerned about the lenders pursuing a deficiency judgment. Can both lenders pursue judgments? We paid 149,900 for the condo in 2005 and the fair market value is currently at 37,000-40,000. I read that there is a law protecting homeowners that the lenders can seek no more than the fair market value of the home. What does that mean? For example if we paid 149,900 and the home value now is say 40,000 but they get 30,000, do they sue us for the remaining 10,000? Or is this just wishful thinking? What can they take if they pursue a judgment? I am praying that they don't but need to be prepared if they do. Any advice would be more than appreciated. |
