| Posted: 12 Jul 2011 06:03 PM PDT I have deposited 2000.00 EMD with Ticor Title co. to buy a short sale property in February 2010, the sale fell through because the seller has vanished. The property has now been auctioned by Bank of America in June 2010. I then claimed the refund of my EMD but the title co. refusees to refund unless the seller signs a cancellation of the RPA. Since the RPA and the seller's signature are of no legal validity after the foreclosure and auction by the lender. What is my legal position here to get my EMD back from the Ticor Title co. , without the seller's signature to cancell the RPA. Thank you. |
